The course examines the scientific value and methodology of economic analysis as a way of understanding the structure and evolution of the legal system. Selected rules and institutional forms drawn from the common law of tort, property, contract and crime are studied as evolved responses to particular kinds of market failures, scholarly sources in both law and economic theory are used extensively throughout the course.

MAJOR READINGS

All readings on reserve. Drawn from
economic sources (authors such as R. H. Coase, and F. A.
Hayek) as well as legal and judicial writing. Substantial
readings in case law.
Textbooks: To be determined.

EXAMINATIONS AND ASSIGNMENTS

Three graded essays, each 6-8 pages. No final examination.

Unless preregistered students attend the first class meeting or communicate directly with the instructor prior to the first class they will be dropped from the class list.
